作者试图以信息收集及财产权划定的社会成本比较开发许可制与土地使用分区管制的利弊,认为在财产权划分不清的情况下(事实上土地交易亦如此),开发许可制因尊重市场机能而能促进土地资源有效率的分派,其立论是薄弱的。
The analytical comparison isbased on the social cost of informationgathering and property rights delineation.The main thesis is to argue that,underthe condition of ambiguity of propertyrights which is often true for landtransactions,the claim that the permitsystems may enhance efficient alloca-tion of land because they are consis-tent with market mechanisms is theo-retically unsound.
