关于器官移植的立法问题的探讨

器官移植是 2 0世纪医学领域的一项重大成就。鉴于我国器官移植的现状 ,在进行器官移植立法时需要考虑供体的来源、器官移植的实施条件、供体者与受体者的权利与义务、以及相关违法行为的处理等。器官移植立法要从我国的实际情况出发 ,借鉴国外成功的经验 ;应对脑死亡进行立法 ,树立按脑死亡标准判断机体死亡的观念 ;要在法律的高度上监督器官移植的实施 ,使器官移植供体的来源合法化 ,限制供体来源的商业化 ;器官移植行为必须规范化 ;

Organic transplant is an important achievement in medical field in 20 century. Legislation of organic transplant must be considered from many facets, such as source of supplier, implementation of organic transplant, right and obligation of supplier and receiver, and regulation of illegal activities, and so on. Legislation of organic transplant should be based on our accurate situation and use the foreign experiences for reference. Brain death should be legislated and establishing a concept that is to judge a body dead according to the standard of brain death. It should supervise the implementation of organic transplant with the law, make source of supplier legal and limit the commercialization of source of supplier. The behavior of organic transplant should be standardized. In addition, it should consider the economic burden for patients and their families.
