论加害给付制度及其立法完善

合同法和侵权法各有自己的适用范围和适用对象。加害给付是一种不可避免的现象,而加害给付是既违约又侵权的一种特殊现象。本文就加害给付的构成、加害给付与责任竞合及加害给付的法律救济等内容进行论述,以期达到完善加害给付理论的目的。

Both contract law and tort law have th eir own suitable scope and object.In jury delivery is a special phenomenon which is not only a breach of contract but also a to rt.So this paper deals with the general conditions,characteristics and types of injury delivery,the making -up of injury delivery,the re lation of injury delivery and obliga tion competition,the law remedies o f injury delivery and so on,so as to improve the theory of injury deliv ery.
