我国199r7《刑法》大幅度增加了罚金刑的适用规定,但在适用中仍存在应罚不判、罚金空判等问题,分析其原因在于罚金刑制度本身存在缺陷,对此,本文提出了一些建议和对策,以期完善我国的罚金刑制度。

The Criminal Law increases the suitable regulation of fine punishment in 1997, but in practice, there still exist some problems that the cases should be punished, but don' t be declared, and fine empty problem of declaring etc. Its reason lies in the aspect that the fine exists in punishment system itself. To the problems, the article brings forward some advice and measures, hoping to make it prefect.
