计算机病历法律效力的思考

Study on Law Validity of Computer Case History

本文依据我国现行法律 ,提出了计算机病历证据的立法缺失及与现行法律的冲突。以期唤起法、医界对此问题的必要关注 ,通过尽快立法或采取有效对策 ,尽可能避免计算机病历证据在司法实践中可能面临的种种困惑、冲突或不确定状态 ,力求计算机病历证据的真实、可靠性和应用的合法性 ,从而保持病历证据的原始性。

Based on the legislation deficiency of the computer case history evidence in conflict with the existing law, legislation is necessary to ensure the verity, authenticity and validity of the computer case history evidence in the judicial practice.
