摘要
商品房预售合同就其性质而言是买卖合同的一种,但不是一般的买卖合同,而是一种特殊形式的房屋买卖合同。它也不同于一般的分期付款买卖合同。它虽然是预售合同,但不是预约,而是本约。预售合同以登记为生效要件,这种登记不同于产权登记,房屋预购人取得的权利不是房屋的所有权,仍然是一种债权。
Commercial housing pre-selling contract is a buying-selling contract in itself but different from the common ones;instead a special form of house buying-selling contract. A pre-selling contract is a source appointment rather than a pre-appointment. Pre-selling contract does not come into effect until registered. The registration is not property right registration:what pre-sellers get is not the ownership of houses but a kind of creditor's right.
