论不动产物权登记的效力

摘要 关于不动产登记效力的问题 ,目前在我国出现的问题表现为其效力不统一。按照世界其他国家的做法 ,不动产民事立法应规定登记的效力 ,原则上应坚持登记要件主义。根据最高人民法院 1984年发布的《关于贯彻执行民事政策法律若干问题的意见》第 5 6条规定 :“买卖双方自愿 ,并立有契约 ,买方已交付了房款 ,又没有其他违约行为 ,只是买卖手续不完善的 ,应认为买卖关系有效 ,但应办房屋买卖手续。”这一规定补充是合理的。制定中的物权法应采纳这一规定。 In regard to real estate registration effect in our country,the author believes that the problem is a lack of system standardization.To adapt to the worldwide mainstream practices,our civil laws concerning real estate property rights should,in principle,follow the suit of'elements'registration,so as to stipulate registration effects.Item 56 of Regulations on Civil Policies and Laws issued in 1984 by the Supreme People's Court states that'A real estate transaction is legally effective on the condition that the seller and the buyer have signed a contract of their own wills and that the buyer has already paid.Transaction procedures must be completed.'The author thinks that this can also be applied to the Property Rights Law being drafted.
