摘要
本文在对国内有关人力资本产权问题研究进行综述的基础上提出 :①在判断人力资本所有权归属问题上 ,同样应该适用“谁投资 ,谁所有”的产权原则 ,即人力资本可以有多个所有者 ,而非专属于人力资本的承载者个人 ;②人力资本的收益权问题只有一个 ,人力资本应否及如何分享企业利润的问题 ,不应与企业所有权问题混淆 ,将人力资本产权与企业所有权问题联系在一起是一种错误的研究思路。
Based on a comprehensive review on the domestic literature about property rights of human capital, this paper concludes with:(1)that the principle, “the investors nust be the owners”, is always applicable to ownership of human capitals. In other words, human capital may belong to multiple owners in stead of being restricted to the capital carrier only;(2)that the benefit rights of human capital, which are related to whether human capital can and how to share the profits in an enterprise, do not equal to the ownership rights of the enterprise. Connecting property rights of human capital with the ownership rights in study is wrong.
