经济全球化背景下的中国经济法

China’s Economic Laws against the Background of Economic Globalization

在对“经济全球化”和经济全球化背景下的政府经济职能进行界定的基础上,着重论述了经济全球化与中国经济法的发展,并指出:“国家协调论”应该成为经济法的理论基础,“协调”是经济法的基本理念;规范政府行为应与规范市场主体行为并举;经济法应与国际经济法共同发展。

On the basis of defining economic globalization and the government ’s economic functions against the Background of economic globalization,the paper concentrates on economic globalization and the development of China’s economic laws .The author is of the opinion that“the theory of the State coordinating”should become the theoretic foundation of economic laws ,and“coordinating”is the basic philosophy of economic laws .The same emphasis should be placed on normalizing both the government ’s and market participants’behaviour ;economic laws should converge with international economic laws.
