摘要
《合同法》中弹性条款的采用 ,不仅扩大了当事人的权利范围 ,同时也扩大了司法裁判者的自由裁量权 ,与现代合同立法的发展趋势相适应。本文旨在对《合同法》中的自由裁量权的有关问题作粗浅探讨 。
The usage of elastic clauses in Contract Law extends not only the rights of the parties, but also the judge's power of discretion. This is the developmental tendency of modern contract legislation. The relavent problems about the power of discretion in Contract Law are discussed in this thesis.
