古代中国与古代罗马的王权与法律的关系比较

Comparison between the relation of monarch power and law in ancient China and ancient Rome

通过对王权与立法的关系、王权与司法的关系以及法律对王权的维护这三方面的对比 ,指出了古代中国与古代罗马在王权与法律的关系上的不同 ,认为古代中国的王权基本上不受法律的制约 ,而古代罗马的王权却在一定程度上受到法律的制约。

By comparison between the relation of monarch power and legislative power, between the relation of monarch power and judicial power and protection of the law to monarch power, the article points out the difference between the relation of monarch power and law in ancient China and ancient Rome. Then the article concludes that in the main the law in ancient China does not restrict the monarch power, but in ancient Rome the law restricts the monarch power to some extent.
