在“应然”与“实然”之间——司法的公信力及司法权运行过程中的“信息失真”

现代社会中的司法承载着树立法律权威、实现社会正义这一神圣使命 ,而只有具有公信力的司法才能很好地完成这一使命。司法公信力的取得不仅需要有适当的“软环境” ,而且还需要一定的“硬件基础”。能够产生公信力的司法是司法的“应然”状态 ,同时也是人们所追求的目标。而在司法权的实际运行过程中 ,由于司法本身所具有的特性以及一些不可避免的客观因素的存在 ,必然会产生各种各样的“信息失真”。对此 ,一是要树立程序正当观念 ,二是要通过建立完善的制度来制约权力的滥用 。

Judicature is burdened the mission of establishing the authority of law and realizing the social justice in modern society. And only when the judicature would be able to set up the public trust that the mission can be fulfilled perfectly, which is always regarded the “due situation” of judicature and is what all the people pursue. Nevertheless, because of the existence of the characters of judicature and of the some unavoidable object factors, there are to be all sorts of phenomena of “distorted information' in the practical exercising process of judicature and in the result of the process. To resolve this problem, we should acquire the outlook of due process and establish perfect systems to restrain the abuse of power and to contain the corruption of judicature.
