To View the Systemic Philosophy of Conflictions of Law Conceptions in Terms of the Relationship between External Truth and Lawful Truth

法律概念的冲突是一个普遍存在的问题。在诉讼法领域内,关于诉讼证明究竟是满足客观真实还是法律真实的要求,争议很大。两种观点分别用认识论加以证明,但矛盾依旧。作者以系统哲学的观点把两个水火不相容的矛盾概念,整合于一个体系之中,解决了其冲突。

The conflictions of law conceptions widely exist in law system. In procedural law, it has been argued for a long time that the objective of certification is to seek lawful truth or external truth. The supporters of the two viewpoints respectively use epistemology to prove the viewpoints, but the differences exist as usual. The arguments were well settled down by systemic philosophy.
