A Brief Discussion about the System of Contractual Spousal Property in China

新婚姻法对夫妻约定财产制作了更明确的规定，但在实际操作中仍存在问题。本文对约定财产制的法律规定、如何适用以及存在的问题等加以分析，认为对约定的时间、方式、约定的变更与撤销等方面仍需加以完善。

The system of contractual spousal property is, in spite of the new clearer stipulations in the new marriage law, confronted with problems in the practical implement. This paper discusses the legal stipulations about the system of contractual spousal property, the ways of its implement and the problems it meets with. It affirms that much is left to be improved in the respects of the timing, ways, changes and cancellation of contracts.
