中国传统法的地域性论略

A Preliminary Study on the Regionalism of Traditional Chinese Laws

中国历史上疆城辽阔 ,各地风土人情各异 ,对法文化有深刻影响。本文从政区变迁和地域差别的角度出发 ,反思对中国传统法既有研究的局限 ,在方法论上提出借助地域性视角研究中国传统法的切入点和步骤 ,并进行了初步的例示性探索。

A vast territory and discrepancies of customs between different regions in traditional China exerted profound influence on her legal culture. This paper reconsiders the limitation of traditional methods in analyzing ancient Chinese laws from the perspective of changes in administrative divisions and regional discrepancies, and exemplifies a preliminary study by using the method of approaching the traditional ways with reference to regional discrepancies.
