摘要
中国“入世”了 ,为了与TRIPS协议保持一致 ,新商标法作了重大修改 ,扩大了商标法可保护的客体 ,确立了驰名商标保护制度及临时措施制度 ,调整了商标确权程序 ,为当事人提供司法救济的机会 ,这将有力促进健康、有序。
China has already been a member of WTO.In order to keep in consistence with the TRIPS Agreement,amended Trademark Law has extended the scope of protectable subject matter,established the system of well known trademark and provisional measures and changed the procedures of certainting rights so as to provide the chance of judicial remedies for the applicant.All of these will do good to build a healthy?orderly and fair competitive market.
