摘要
垄断随着资本主义的发展,已经成为企业购并的显著特征。这样,一方面美国出现大企业的“强强”联合,不断地制造垄断;另一方面美国法律又制约着垄断,通过法律又在肢解着垄断。从表现看,这似乎存在着矛盾,但实际上并不存在矛盾,因为美国法律只对横向合并干预,而对非横向合并没有涉及。所以法律只对阻碍有效竞争进行干预,而对促进经济发展的合并不加以预。这对中国目前的经济状况有一定的借鉴意义。
As Capitalism develops,monopoly has already become a salient characteristics of business purchasing and combination.In America,there have appeared the combination of powerful large enterprises,and monopoly has constantly been formed,on one hand;but the American law constraints and disintegrates monopoly,on the other hand.Superfically,this seems to be a kind of contradiction.But it is not in fact,because the American law just intervenes with intersectoral combination,not with non-intersectoral combination.So the law only interposes in the restraints upon the effectual competition,but does not interfere with the combination that promotes economic development.This monopoly phenomenon is referentially significant to the present -day Chinese economic situation.
