摘要
在城市化过程中 ,集体非农建设用地流转模式可归纳为三种最基本模式 :统征统管模式 ,整体性国有化模式和产权二元化模式。通过对我国现有集体非农建设用地的流转模式进行对比研究 ,文章指出进行制度创新是集体非农建设用地流转的前提 ,建立清晰的产权是集体非农建设用地流转的基础 ,建立合理的土地收益分配制度是集体非农建设用地流转的关键 ,建立合理的土地流转机制是集体非农建设用地流转的保证。应该采取综合措施促进与规范集体非农建设用地的流转。
The collective constructional land transaction models in the process of urbanization can be reduced to three main models: the model of land acquisition and land management by government, the model of general nationalization and the model of dual land ownership in urban areas. According to the comparative study of the transactions of collective construction land, the author points out that the premise of transaction of collective ownership land is the system creation of land property right, the basis of transaction is to form the clear property right, the key to transaction is to set up the system of distribution of benefits derived from urban land and the guarantee is to establish land transaction mechanism. Comprehensive measures must be taken to urge and standardize collective ownership construction land transaction.
