摘要
律师作为西方法律制度的产物 ,在中国法制近代化过程中被引进 ,对中国走向法制文明产生了极其重要的影响。本文从考察近代领事裁判权及会审制度入手 ,探讨在华外籍律师所充当的社会角色及其正反影响 ,并系统阐述了近代华人律师及近代中国律师制度诞生的艰难历程。
Lawyer system, as an outcome of western legal system, was introduced in the course of modernization of Chinese legal system and has much influence on Chinese legal civilization. Beginning with examining the modern Consular Jurisdiction and Joint Hearing System, the thesis explores foreign lawyers' social role and passive & positive influence. It systematically expounds tottering experience of the emergence of the modern Chinese lawyers practice and the Chinese lawyer system.
