结果加重犯共同正犯刑事责任的探讨

Discussion on the Criminal Liability of Consequential Aggravated Criminal and the Joint Principal Offense

二人以上共同实施结果加重犯的基本犯罪 ,发生加重结果的场合 ,是否所有的共同实行行为者都应对加重结果承担刑事责任 ,在大陆法系的刑法理论上 ,称之为“结果加重犯共同正犯的刑事责任”问题。本文阐述并评析了大陆法系相关国家和地区“肯定说”和“否定说”的基本观点 ,立足于我国的犯罪构成理论 ,对结果加重犯共同正犯刑事责任中的争议问题作了必要的探讨 。

Under the condition of the basic crime of consequential aggravated crime committed by two or more people, if all the suspects should bear the criminal liability of the aggravated result or not is called ' the criminal liability of consequential aggravated criminal and joint principal offence' in the theory of the Continental Law System. In this paper, the basic viewpoints with respect to 'affirmative opinion' and 'negative opinion' of the Continental Law System in the related countries and areas are stated and reviewed. Based on the Chinese constitution of a crime and the above disputed questions, the necessary investigations are made and the comparison of related concepts is also made.
