传统理论将妨害民事诉讼强制措施的性质仅认定为“排除手段”、“强制手段”、“教育手段”、“强制教育手段”或“具有制裁性的强制教育手段”皆不够准确。其真正本质应是程序性法律制裁。引起认识混乱的因素主要有重实体轻程序传统的影响以及由此带来的法律制裁理论研究的缺陷、立法设计的误导 ,另外也有法学研究方法的偏颇等。因此 ,正确厘定民事诉讼强制措施的性质对于完善法律制裁理论和民事诉讼法学理论 ,强化人们的程序价值理念 。
