市场经济的发展，内在吁求并必然孕育、催生出一个与之相适应的法治社会──一个以契约、自治等为鲜明特质的高度理性化的“市民社会”。 市民社会的原生秩序是以契约性关系为网络的。中国社会近几年市场经济发展的现实表明，以自由交换、自由权力与自组织行为为基本标志的中国特色“市民社会”的契约化过程已经实实在在地得以发生和开始。“契约文化” 是市场经济社会文化精神的血脉，包孕了独立人格、自由个性、权利平等、科学理性、民主法治、社会责任感等丰富的内涵。社会主义市场经济条件下的“契约文化”，本质上是实现人的解放和全面发展的文化。市民社会的“契约文化”理念的确立与市民社会成员“公民意识”的培育不可分割，这是现代文化观念所奉行的人性自主、自律的深层要求之所在。

The development of Market economy demands,fosters and gives birth to a law-ruled society:a contract self-ruled and highly sensible civil society, whose original order is connected by contract relationship.In china,the development of market economy in recent years demonstrates that the contracted process of the Chinese civil society ,symbolized by free exchange,free rights and self-organized behavior ,appeared and began indeed.Contract culture is the spirit in market economy ,which means independent character,free personality ,equal rights,scientific sense,democracy and rule-by-law and social responsibility .The contract culture under socialist market economy is in essence a culture which realizes men's liberation and full development.The establishment of the ideas of the civil society can't be isolated from the foster of citizen consciousness of member in a civil society .This is the demand in the deep sense of human self-rule and self-control,which are held in modern culture views.
