摘要
保险代位的效力与债权人代位、债的让与的效力有所不同 ,保险人行使保险代位权的效力包括对内效力和对外效力 。
The paper points out that there exists great difference between the enforcement of insurance subrogation and that of transfer of credit and creditor subrogation. The subrogation can be forced from in and out and the force varies along with the actual time of giving-up.
