我国用益物权体系的研究

A Study of the Right of Ususfructus in China

用益物权在传统物权法中主要是关于不动产 (土地及其定着物 )的他物权 ,对于社会的存在和发展具有极为重要的意义。本文首先就适应我国社会发展的实际情况及其发展趋势、体现现有的法律概念和法律规定、反映我国优良文化传统、借鉴外国先进的立法经验、讲究立法技术等方面探讨了构建我国用益物权体系应考虑的主要因素 ;本文的第二部分主要研究了我国用益物权体系的应有内容。对于地上权、农地承包权、典权、居住权和地役权等具体用益物权形态的名称采用、范围、权利和义务结构问题进行了较为全面的阐述。

Right of ususfructus is a kind of jus in re aliena concerning real estate (including land and its attachment) in the traditional law of property right. It plays an important role in the society. The first part of this article discusses the primary factors which should be considered when we construct the system of rights of ususfructus, including accommodating to the practice and the trend of the developing Chinese society and to the existing legal notions and legal system, reflecting our fine traditional culture, adopting the advanced experience of foreign legislation, perfecting the legislative technique, etc. The second part is on the appropriate contents of our system of right of ususfructus, including term adoption, bounds of right, framework of right and duty of some specific rights of ususfructus.
