表见代理现象存在于委托代理之中，但不论是委托代理，还是法 定代理和指定代理，均可能发生表见代理的行为。目前，学术界对表见代理的概念界定仍存 在着一定的分歧，这种分歧又在一定程度上影响了表见代理在法律上的执行。因此，明确界 定表见代理的概念，充分认识其表现形式，严格掌握其归责原则，对我国立法制度的进一步 完善有着重要的现实意义。

：The agency by estoppel exists in entrusted agenacy, al though it is, regardless of entrusted agency, statutory ageney and appointed age ncy,the agency by estoppel action could occured in the 3 kinds of agencies too. There have been divergences on the conception of agency by estoppel, and these d ivergences,influences exist as a barrier in the way of the agency by estoppel to be carried out by law.Therefore there is an important and immediate significance to draw a clear line for the agency by estoppel, to have a correct understanding o f its existing forms, to control the criterion of liability,etc. in perfecting l egislation of China.
