摘要
我国新《婚姻法》及司法解释第一次确立了离婚过错赔偿制度 ,这对保护婚姻的无过错方利益 ,惩治过错方起到了很好的作用。本文通过对离婚过错赔偿制度的存在性、构成要件和赔偿范围进行阐述 ,明确了这一制度的适用条件 ,并针对现行立法中存在的某些问题 。
The new marriage law and legistalative explaination set the fault compensation system for the first time. This will do great benefit to protect the no-fault party and to punish the fault party.This paper analyzes the existing and compensation domain of fault compensation system in divorce, demonstrates the adoptable terms of principle and puts forward some opinions about the existing legislative problems currently.
