在竞争的市场环境下 ,竞业禁止制度成为企业保护其商业秘密的一种重要手段。世界各国也纷纷以立法形式对其加以规定 ,但我国对这方面的立法还相当薄弱。我国应在借鉴外国有关立法的基础上 ,在《反不正当竞争法》中对竞业禁止作专条规定 ,以保护商业秘密权利人与竞业禁止相对人的合法权益。

Competisng for job prohibition means a law ful system that provides that the staff members who have commercial secret should not stant one′s own business or participate in a joint enterprise of the same sort when one is in office or in a certain time after leaving office.
