当前我国的反腐败法治机制还存在很多缺陷。根据经济分析法学的基本原理分析,我国反腐败法治机制存在缺陷的原因在于反腐败群推动反腐法治工作所投入的成本大大超过由此产生的收益,从而缺乏推动反腐法治工作之激励。因此,完善反腐败法治机制必须依循成本效益规律,在立法、执法和法律监督等方面注意加大腐败成本、提高反腐败收益。

Imperfections still exist in China's anti - corruption mechanism of rule by law.The reason for it lies in a lack of impetus to the construction of the mechanism,Which means that the cost of the work exceeds greatly its gain,according to an analysis based on the essential principle of law and Economics. Thus, to perfect the mechanism we have to increase the cost of corruption and the gain of anti - corruption from legislation, execution of law and suprevision of law, following the law of cost and gain.
