美国反垄断立法给我国的启示

Some Enlightenment from US Anti-Monopoly Legislation

文章从三个方面探讨了美国反垄断立法给我国反垄断立法带来的启示。首先,介绍了美国反垄断立法的概况:《谢尔曼法》的通过,垄断是严重犯罪原则的确定,美国反垄断专门机构———联邦贸易委员会的创立以及从八十年代开始的美国反垄断立法思想的转变。次之,论述了中国反垄断立法的现实性和必要性,指出,中国的垄断行为尤其是行政垄断行为非常严重,制定反垄断法已迫在眉睫。最后,论述了美国反垄断立法给我国反垄断立法带来的三点启示,呼吁在我国尽快出台反垄断法,让垄断这头“经济怪兽”在法律面前“俯首贴耳”。

This article discusses US anti-monopoly legislation which may bring enlightenment for China to enact its own anti-monopoly laws in three divisions:firstly,the author briefly introduces US anti-monopoly legislation,pointing out that the passage of Sherman Act confirms that monopoly is a serious crime ,the establishment of Federal Trading Committee specialized in fighting monopoly and the transformation of US anti-monopoly legislation mindset since the early1980s;secondly,the author discusses the feasibility and necessity of enacting China's anti-monopoly legislation,indicating that monopoly in China,esp.administrative one,is very grave;finally,the au-thor presents three points enlightened from US anti-monopoly legislation which will benefit Chi-nese lawmakers,calling on urgent legislation of China's anti monopoly laws so that monopoly,so called economic monster,will be tamed by laws.
