摘要
中国古代的犯罪学思想最早可追溯到夏商周三代时期。先秦儒家承袭了前代的犯罪学思想 ,但又予以改造和发展。先秦儒家的犯罪学思想是世俗的思想理论 ,这一理论摆脱了神权的束缚 ,以民本主义的观点对犯罪问题进行了诸多探讨 ,在中国法律思想史上曾有深远的影响。先秦儒家的犯罪原因理论、先秦儒家的犯罪防治主张以及伦理(道德 )与犯罪之关系三个方面的问题是本文探讨的主要内容。
The thoughts on criminology originated in Xia, Shang and Zhou Periods in ancient China. The Pre-Qin Confucianists inherited the previous thoughts on criminology, but also reformed and developed them. These thoughts on criminology of the Pre-Qin Confuciansits belong to the secular theory which broke away from the yoke of theocracy and went further into many issues on crime from the perspective of common people. And this theory once produced a far-reaching significance in the Chinese legal thoughts history. This article mainly deals with the following issues: the theory on the reasons of crime of the Pre-Qin Confuciansits, the views on the prevention of crime of the Pre-Qin Confucianists and the relationship between ethics (morality) and crime.
