On the Characteristics of EU Civil and Commercial Jurisdiction

欧盟民商事管辖权是欧盟民事诉讼法的核心问题。该文通过对相关理论与实践的分析,概括出欧盟民商事管辖权的三大特征,即它是介于“国际管辖权”与“区际管辖权”之间的特殊性质的管辖权,是司法管辖权,是广义的民商事管辖权。

The civil and commercial jurisdiction of European Union (EU) is the core of EU civil procedural law. Through elaborate analysis on the relative theory and practice, the author summarizes three characteristics of EU civil and commercial jurisdiction: it has the special feature, which stands between international jurisdiction and interregional jurisdiction; it is judicial jurisdiction; and it is civil and commercial jurisdiction in a broad sense.
