论道德法律化的限度

On the Limit of Moral Legalization

法律制度的完善和充分实施可以为道德建设提供制度保障 ,推动道德的发展 ,这使得道德的法律化成为可能。但道德的法律化是有限度的 :从范围上看 ,有些社会关系主要靠道德来调整 ,法律只起辅助作用 ,甚至不能适用法律 ;从功能上看 ,法律直接规范人的行为 ,但对人的思想并不具有直接的约束力 ;从道德发展的角度看 ,法律不能超越历史阶段保障高层次的道德要求 ,而且对法律的过度依赖还会导致道德的弱化。因此 ,我们在树立法律最高权威的同时 ,还应充分重视道德等其他调控手段的作用 ,避免法律对道德领域的过度介入。

The perfection and full implementation of legal system can provide a system guarantee for moral construction and promote the development of morality,which has made moral legalization possible.However,moral legalization has its limit.In range,some social relations mainly rely on the adjustment of morality and law plays the auxiliary part.Sometimes,law doesn't work.In function,law can regularize the people's behavior but can have no direct binding effect on the people.In moral develpment,law can not go beyond the moral requirements for high levels in history.What's more,relying too much on law will cause the weakness of morality.Therefore,while we are establishing the practice of 'law above everythink',we must pay full attention to morality as a regulating tool and avoid the over-interference of law in morality.
