摘要
承运人航海过失免责制度从 1893年美国《哈特法》制定以来到今天已有一百多年的历史 ,至今仍在国际航运业中被普遍采用。通过借鉴美国 1999年 COGSA和 CMI框架文件中合理的部分 ,论述我国海商法取消承运人航海过失免则的规定 。
The present paper deals with the necessity of canceling in accordance with China′s maritime law the carrier′s being exempt from unpremeditated crimes in navigation or management of the ship so that the law can catch up with the general developing tendency of the international maritime law.
