离婚损害赔偿制度是我国婚姻法修改过程中新增设的一项重要制度。阐明增设离婚损害赔偿的必要性、法律依据、责任构成、特点及功能 ,提出相应的司法建议 。

The system of compensating for divorce is an important law , added to Chinese marriage law during its amendment . This thesis discusses the necessity of supplement , legal basis , constitutive responsibility , characteristics and functions , and puts forward connected judicial suggestion in order to understand and utilize the law well .
