Minor Enterprise Legislation as Seen from the Improvement of the Policy of Industrial Structure

中小企业立法总体上看存在社会政策型和产业政策两种相互对立的模式 ,前者着眼于社会福利的平衡 ,后者重视市场竞争机制的效能 ,建立产业政策型中小企业法律制度是现代各国中小企业立法的基本目标 ,建议我国中小企业立法采用产业政策型模式 ,以期改善我国的产业结构并形成自由、公平。

There exist two patterns opposite to each other concerning minor enterprise legislation as seen from the totality: one is social policy type; while another is industrial policy type. The former fixes eyes upon the balance of social welfare; while the latter values the efficacy of market and competition mechanism. To set up a minor enterprise legal system of industrial policy type is the basic objective of minor enterprise legislation in different countries at modern times. The author suggests to adopt the pattern of industrial policy type, hoping for improving industrial structure of our country and forming a free, fair, and orderly environment.
