A Comparison of the Authentication Institution in the Two Legal Systems and Reference Drawn

认证制度是指对证据证明效力的审查判断制度。英美法系与大陆法系由于历史、地理、文化等诸环境的差异,导致在认证主体、认证程序模式、认证效力、认证方式和认证规则等方面均有各自的特点。试通过对这些特点的比较,旨在对我国认证制度的完善有所借鉴。

The authentication institution refers to that of examination and judgement of the effect of testimony. Historical, geographical, and cultural differences between the legal system of America & Britain and that of China result in many distinctive features in their respective authentication institutions. For instance, there exist distinguishing features in the authentication subject, in the pattern of the authentication procedure, and in the effect, the mode and the rules of authentication. Through a comparison of these features, the paper attempts to bring out what can be referred to by the authentication institution of our country.
