On Economic Crimes Committed by Units

单位经济犯罪是单位犯罪的一种主要类别。单位经济犯罪的主体应是合法组织 ,实行行为具有人格化 ,正是由于利益的驱动性 ,使单位经济犯罪具有意志整体性 ,罪刑法定原则决定了单位经济犯罪的法定性。单位的分支机构和内部组织必须具备一定的条件才能成为单位经济犯罪的主体 ,国家机关不能成为所有单位经济犯罪的主体。在认定单位经济犯罪时 ,应注意区分其与共同犯罪的界限 。

Economic crime committed by a unit is a main form of unit crimes. This paper gives a detailed study of the characteristics of economic crimes committed by different units--its subject, its motivation and its other features.The author holds that the subdivisions or the branches within a unit could be the subjects of such crimes only under a certain condition and that a distinction should be made between economic crimes committed by units and crimes committed with conspiracy.
