摘要
本文从立法、司法和理论的角度对中德两国对情势变更原则的规定加以分析 ,罗列了两国相关立法模式并分析各自的立法背景和目的 ,对我国在司法实践中如何合理运用情势变更原则提出了建议。
The article gives a systematical comparison between Chinese and German principles of change of circumstances from the proints of legislation,judicature and theoretical study and analyses the differences between two models and its reason.Then some legislative suggestions and judicial manner towards the system of the change of circumstances are given.
