国务院《医疗事故处理条例》已经颁布,新条例明确了医疗事故纠纷处理的三种方式:司法诉讼、行政处理和医患协商。该文通过对医疗事故纠纷三种处理方式的分析,阐述了新条例上述规定的法律价值,并对医患双方在发生医疗事故纠纷后采用何种处理方式提出了建议。

In the Regulations for Settling Medical Ma lpractice Cases promulgated by the State Council,th ree methods have been defined to handle the medical tangle caused b y medical malpractice:judicial law suit,administrative processing an d hospital-patient agree-ment.Through the analysis on the thr ee processing methods ,this thesis e xpounds the legal value of new regula tion ,and makes some sug-gestions as to which methods should b e preferable when medical tangle arises.
