医患关系的法律和伦理调整辨析

On the Legal and Ethical Regulation of the Doctor-patient Relationship

医患关系的调整范畴是目前学术界争议的热点问题,笔者认为医患关系界定不清的关键在于对医方主体认识的笼统和模糊。作者试从医方主体两个层面的驳离来分析医患之间的法律和伦理关系,指出医疗机构与患者的关系应适应法律调整,医务人员与患者的关系应适应伦理调整。

The understanding of the regulation on the doctor-patient relationship is a hot spot in dispute in the academi c circles.The author maintains that the unclear definifion of the doctor-patient rela tionship can be attributed to the hazy understanding of the subject of the medical service provider.This p aper studies the doctor-patient relationship from two dimensions of the medical service provider and points out that the relationship between medical institution and patien t should be regulated by law while the relationship between medical staff and patient should be regulate d by ethics.
