General Agreement on Trade in Services & Legislation on Sino-foreign Joint Educational Activities

面对中国加入 WTO和中外合作办学活动的新变化 ,中外合作办学的立法应采取以下对策 :1 .坚持教育主权原则 ;2 .在立法上给中外合作办学恰当定位 ;3 .提高立法层次 ;4.修改现有规章并进一步丰富其内容 ;5.针对 WTO《服务贸易总协定》的规定 ,完善中外合作办学的法律。

With China's entry into the WTO, the currently existing Chinese legislation needs updating in order to keep up with and to effectively regulate the changing Sino-foreign joint educational activities. This article proposes that legislation governing Sino-foreign joint educational activities adhere to the principle of educational sovereignty, that these activities be permitted by the Chinese legislature as profit-making and that upcoming legislative measures be taken in accordance with rules of General Agreement on Trade in Services.
