论民事诉讼中法官独立的制约平衡机制

On the constraining and balancing system in which a judge is independent with regard to a civil lawsuit

在赋予法官独立的权力之同时 ,必须有相应的制约平衡机制 ,主要有两个方面 :一是完善基本审判制度和建立法官错案追究制度 ,实现内部制约 ;二是建立政党监督 ,完善包括人大监督、新闻监督以及公众监督在内的外部制约。

When a judge is conferred an independent authority, there must be some mechanism to constrain and balance such a power. This can be represented in two respects: Firstly, we must consummate a juridical system and set up the system of investigating the judge in case of his mistake in judging a law case in order to arrive in an internal constraining. Secondly, we must set up a system containing party supervision, congress supervision, journalist supervision, and personality supervision in order to arrive in an external restriction.
