:医疗事故处理中精神赔偿责任的构成包括 4个方面 :医疗事故的成立、精神损害事实的存在、二者的因果关系、医务人员的过错 ;并对建立医疗事故处理的精神赔偿机制提出了思考 :精神损害赔偿的性质和功能、适用对象。

The author holds that the formation of responsibility for mental compensation in malpractice lawsuit includes four aspects: confirmation of malpractice, existence of facts of mental injury, cause-effect relation between the two, and the faults of medical workers. The author also presents speculations on the mechanism for mental compensation and deals with the natures and functions of mental compensation, applicative people and principles for the establishment of compensation fee.
