摘要
本文首次运用典型案例分析了银行业的行为风险与金融消费损害之间的逻辑关系,并运用750个案例作了统计检验。尽管不同个案中行为风险与金融消费损害相关程度存在差异,但总体上二者存在统计相关性,金融机构行为风险对金融消费损害具有较好的解释力。信息资料损失结果与消费者信息资料管理行为风险、强制交易结果与交易服务行为风险存在典型的一一对应关系,交易服务行为风险与产品不适用、所办业务损失和强制交易等存在相关性,资金财产损失结果与消费者财产管理、合同行为与产品设计等相关。近七成违法侵害源于金融机构藐视消费者合法权益的傲慢态度;不违法的金融消费损害难以维权,这种以寻利为目的不违法损害掩盖了部分金融机构服务的虚伪性。
For the first time,this paper analyzes the logical relationship between conduct risk and financial consumer harm in China banking industry using typical cases,and make statistical tests by using 750 cases.Although there are differences in the correlation between conduct risk and financial consumer harm in different cases,there is statistical correlation between the two,and financial institution conduct risk has an obviously effective explanatory power for financial consumer harm;information data loss results and consumer information data management conduct risk、compulsory transaction results and transaction service conduct risk are typical one-to-one correspondence.There is a correlation between the conduct risk of transaction service and the inapplicability of products,business losses and compulsory transactions.The results of financial property loss are related to consumer property management,contract and product design conduct;nearly 70%of illegal violations stems from the arrogant attitude of financial institutions defying consumers’legitimate rights and interests;non-illegal financial consumer harm is difficult to defend rights.This kind of non-illegal damage for the purpose of seeking profit covers the hypocrisy of some financial institutions.
