关于高校管理中法治与德治相结合的思考

A Thinking of the Combination of Ruling by Law and Ruling by Morality in the Management in Higher Institutions

新世纪之初,江泽民同志在全国宣传部长会议上的重要讲话,明确提出了“依法治国”与“以德治国”是相辅相存、相互促进的,我们应“依法治国与以德治国紧密结合起来。”这为国家管理正确处理法治与德治的关系提供了根本指针。中国古代思想家曾提出“以德治国”的论述,但在今天它作为重要的治国方略,是深刻总结国内外治国经验的基础上作出的科学论断。在其指导下,新的历史时期高等学校的管理应该而且必须实现依法治校与以德治校的有机结合,本文论述了法治与德治相结合的传统依据,以及在高校的统御管理、教师管理和学生管理中实现法治与德治相结合的思考,以求高校管理新的探索。

At the beginning of the new century, President Jiang Zemin clearly points out that Ruling by Law and Ruling by Morality are supplement each other, and improving interactively in his important speech in the meeting of the ministers of National Publisity Ministry. This provides an essential guidance to deal properly with the relation between Ruling by Law and by Morality. Even Chinese antient thinkers had stated the theory of Ruling by Morality,it is regarded as a strategy of the administration of a country and a scientific conclusion, based on the summary of the experiences of the administration of a country in and outside China . With the guidance of the theory, in the new historical period , the management of higher institutions should and must combine the ruling institutioms by law and by morality intergrat-edly. The paper states the traditional basis to the combination of Ruling by Law and by Morality, and the thinking of the combination of Ruling by Law and by Morality in the fields of the macroscopical management ,of the stuff management, and of the student management in higher institutions, eventully to a stage of new exploration of it in the management in higher institution.
