法官资格取得制度的比较与思考

Comparison between judges' qualification acquisition systems and thought on it

通过与其他国家有关规定进行比较可以发现 :我国现行立法对法官资格和法官选任方式所作的规定 ,存在着任职资格过低、选任方式不科学、难以保证司法独立等弊端。

By means of making a comparison between our judges' qualification acquisition system and relevant stipulations of other countries,we find that in the stipulations for judges' qualification and ways to choose and appoint judges in our country's current legislation there are defects such as the requirement for judges' qualification's being too low,choosing and appointing methods' being unscientific and the stipulations' being unable to guarantee judicial independence,etc.Therefore,our country's current judges' qualification acquisition system must be reformed.
