英国慈善法中的公益性标准及启示

The Public Benefit Requirement in Charities Act of England and Its Enlightenment to China

公益性标准在英国慈善法中具有极其重要的地位,体现了慈善的核心价值。现行英国慈善法中有两个关于公益性标准的基本原则,即慈善组织的公益性必须是可识别的、客观的;慈善组织的受益人必须是社会公众或社会公众的一部分。在英国慈善法中,慈善的公益性标准主要通过慈善组织发布公共利益报告和慈善委员会对公共利益进行评估的途径得到实现。借鉴英国慈善法中的公益性标准,我们应该通过完善慈善事业法规政策体系明确规定慈善组织的公益性标准,并设立专门监管机构负责公益性标准的实施。

The public benefit requirement occupies an important place in Charities Act of England and embodies the core values of charity. There are two principles of public benefit in current Charities Act of England, i.e. there must be an identifiable benefit or benefits~ benefit must be to the public, or a section of the public. The Charity Commission meeting the public benefit requirement in the following ways, i.e. reporting on and assessing the public benefit of charities. In order to draw on the experience of the public benefit requirement in the Charities Act of England, we should define the public benefit requirement in our charities laws clearly and establish specialized agency to be responsible for meeting the public benefit requirement.
