在长达几千年的中国古代社会,最高统治者都期望通过反腐惩贪的立法使贪官污吏的犯罪活动得到抑制,立法对反腐惩贪起了重要作用。然而很难形成反腐惩贪的长效机制。这其中包括立法主体的日趋腐败、人治而非法治的社会以及执行难等多种原因,因而反腐惩贪的法律也就经常成为一纸空文。
