摘要
农村宅基地使用权流转在理论和实践中呈现出不协调状态。在分析农村宅基地使用权流转现状以及农村宅基地土地使用权流转合理性的基础上,分析其流转的保障措施:应当正确定位政府公共政策形成功能;完善农村宅基地登记制度;修改现行农村宅基地流转政策,以总量控制的方式,限制宅基地使用权转让,禁止投机或投资行为,预防农村宅基地使用权流转过程中侵损农民合法权益和损害基本耕地的现象。
Use right transference of housing land in rural areas have been in controversial conditions in theory and practice. Based on the analysis of the use right transference of housing land in rural areas and its rationality, ensuring measures are analyzed. The function of the position of government public pol- icy should be corrected. Registration system for housing land in rural areas should be established and the existing transference policy of housing land in rural areas should be modified. Total control should be ap- plied to limit the use right transference of housing land in rural areas, prohibit speculation or investment, and prevent the infringement of legitimate rights and interests of farmers, and the basic farmland damage in the rural free transference of housing land in rural areas.
