监狱法律援助之困境与对策研究

On the Dilemma of Prison Legal Aid and the Countermeasures

监狱法律援助制度的构建无论是从服刑人员的个人利益出发,亦或从社会整体利益来看,都是十分必要而可行的,但该制度在实际推行过程中却遇到法援形式单一,主体参与意识不强,缺乏物质保障等问题。由此,可通过加强宣传力度,延展监狱法律援助的覆盖面,设立援助基金等措施的实施,探索监狱法律援助工作的新思路、新办法,从而切实维护服刑人员的合法权益。

The construction of the prison legal aid system is necessary for the personal interests of prisoners and the overall interests of the society,but in practice many problems arise,such as the lack of flexible forms,the weak sense of participation,and the lack of material aid.Therefore,it is necessary to strengthen publicity,extend the coverage of prison legal aid,establish the aid fund,and seek new approaches of aid for prisoners.
